The privacy policy (this “Privacy Policy”) of this website (the “Website”) made available by Dart Realty (Cayman) Ltd. (“DRCL”) explains the online information practices of DRCL regarding the collection of data from you as part of the normal operation of the Website and explains how DRCL uses or discloses this information.

IMPORTANT NOTE: By accessing, using, or viewing the Website, you expressly consent to DRCL’s collection, use, and disclosure of your personal information in accordance with the terms and conditions of this Privacy Policy.  This Privacy Policy is incorporated into and subject to the Terms of Use for the Website (“Terms”). People who visit the Website shall be referred to as “Visitors.”

In this Privacy Policy, reference is made to DRCL’s “affiliates,” which shall include companies that are affiliated with DRCL by reason that these companies are in the same common ownership as DRCL. Affiliates shall also include the parent company of the group of which DRCL is a member.

Collection of Information

It also may collect the name and URL of the Website that you visited immediately preceding your visit to the Website. DRCL may use this type of non-personal information on a cumulative basis to better understand what pages Visitors access or visit, and DRCL may disclose this information to companies affiliated with DRCL as well as to business and trade partners of DRCL for any purposes whatsoever.

This Privacy Policy also relates to DRCL’s collection and use of any personal information through your use of DRCL’s Website and any personal information that you provide to DRCL through email. DRCL shall explain in this policy what information DRCL collects about you through your use of the Website or when you email DRCL and how DRCL uses that information. When you participate in, access or sign up to receive any online Content, such as emails and other publications, DRCL may receive personal information about you. DRCL will use your personal information for a number of purposes which include, responding to your requests for information or publications, adding your details to DRCL’s list of persons who receive DRCL publications and providing these to you on a regular or as requested basis. DRCL will also compile data based on responses received from Visitors in order to allow DRCL to analyze the experience of Visitors so that DRCL can improve the services that DRCL currently offers and to allow DRCL to predict future services that DRCL may consider offering. Note that requesting information using the Website will not confer any right for you to receive a response. Any requests for information may be responded to entirely in the discretion of DRCL and there is no obligation on the part of DRCL to respond or to provide any information.

Children’s Information Policy

DRCL does not knowingly solicit any personal information from minors. If DRCL is made aware that DRCL has collected personal information from a minor under 16 years old then DRCL will delete this information as soon as practicable.

The information DRCL collects is used to respond to inquiries, improve the Content of the Website, and the quality of DRCL’s service and to provide information to DRCL and its affiliates for their respective business purposes.  The personal information (including your email address) DRCL collects is not shared with third parties nor is it sold to other organizations for commercial or marketing purposes, save and except when: (1) it is necessary to share information in order to investigate, prevent or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, or as otherwise required by law, (2) where DRCL has your permission to share the information, (3) such information is seen by third parties who provide web services or professional services to DRCL, (4) such information is shared with affiliates of DRCL; (5) it is necessary to protect the rights and property of DRCL; (6) in the event of a Transfer, as set forth in Section 6, (7) in response to legal process (for example, a court’s order), (8) in response to a law enforcement agency’s request, (9) where otherwise required by applicable laws or government requirements, or (10) when investigating and correcting technical problems and malfunctions in the Website or the computer systems that support the Website or (11) if it is necessary to investigate, prevent or take action with regard to a violation of the Website or in respect of the Terms or to verify or enforce compliance with the policies (including but not limited to the Privacy Policy) governing the Website.

Personal information may be available to third parties as noted in the preceding paragraph. DRCL makes no representations or warranties about the acts or omissions of such third parties, including whether such third parties will keep such information confidential.  When you contact DRCL and provide information to DRCL, you do so at your own risk, and DRCL shall not be liable for any misuse of such information by a third party.

Ownership and Storage of Information

DRCL and its licensors own the code, databases, and all rights to the Website and any feedback you provide save and except that as between you and DRCL, subject to the terms of this Privacy Policy, you retain all rights to the personal information you provide to DRCL through the Website. If you incorporate into feedback any Content (as defined in the Terms), you hereby grant DRCL a worldwide, non-exclusive, royalty-free, sublicenseable and transferable license to use, reproduce, distribute, prepare derivative works of, and display the Content when operating the Website and for DRCL’s internal business purposes.

DRCL may also indefinitely store any information that you provide to DRCL or any of its affiliates through the Website. No representations or warranties are made as to how that information is stored, and in particular, you should bear in mind that no matter what precautions may be taken, such information may be hacked in a cyber-attack. DRCL and its affiliates also reserve the right to delete such information for any reason and for no reason.  DRCL and its affiliates also assume no responsibility for loss of information, howsoever such information is lost, including information which is permanently deleted either through the actions of an employee or consultant or other who has access to the information, through failures of a computer network, or through any policy or directive of DRCL or any of its affiliates for destruction of data.

Transfer of Information

Contact lists and information are properly considered assets of a business. Accordingly, if DRCL merges with another entity or if DRCL sells DRCL’s assets to another entity (collectively referred to as a “Transfer”), DRCL’s contact lists and information, which may include personal information you have provided DRCL, would be included among the assets that would be transferred and DRCL would request that the entity treat your information in accordance with the Terms (including this Privacy Policy).  DRCL makes no guarantee as to whether such entity will treat your information in accordance with the Terms (including the Privacy Policy) and disclaims any liability arising out of such entity’s failure to do so. This same provision is applicable for each affiliate of DRCL.

Although DRCL takes reasonable measures to ensure the security of the data you may choose to provide DRCL from loss or misuse, unfortunately the transmission of data through the Internet cannot be guaranteed to be 100% secure. Neither DRCL, nor any of its affiliates, nor any of their respective employees, officers or agents or the provider of the internet services on behalf of DRCL or the creator of the Website (nor any other person involved in the management or establishment of the Website or otherwise involved in respect of the Website) can give any representation or warranty as to the absolute security of the data transmitted using the Website and cannot give any guarantee that such data will not be compromised by bad actors.
